High Courts in India

Subject: Polity

Book: Indian Polity by M. Laxmikanth

High Courts function as top judicial authorities in each state (or group of states), overseeing subordinate courts. They possess original jurisdiction in certain cases (e.g., enforcement of fundamental rights under Article 226), appellate jurisdiction, and powers of superintendence. Judges are appointed by the President in consultation with the Chief Justice of India and the Governor. High Courts can issue writs, ensuring protection of citizens’ rights at the state level. They also interpret state legislation. The principle of judicial independence is upheld through security of tenure, though transfers of judges among High Courts maintain uniform standards. They act as an indispensable link between Supreme Court and local judiciary.
